Acceptable Use Policy

Email deliverability depends on every sender behaving responsibly. Because our clients share sending infrastructure, one bad sender can hurt everyone's inbox placement. This policy sets out what you may and may not do when sending through Nimbl Mail. It forms part of our Terms of Service, and accepting it is required before you can send.
1. Permission based sending only
You may only send email to people who have given you clear permission to contact them, for example by signing up to your list, buying from you, or otherwise opting in. You must be able to show how and when each recipient gave consent.
- No purchased, rented, scraped, or harvested lists.
- No sending to addresses you have not collected yourself with consent.
- No adding people who only gave you their address for a different purpose (for example a support query) without their agreement to receive marketing.
2. Every email must let people opt out
Every campaign must include a working, easy to use unsubscribe link. We add one automatically if your template does not, but you must not remove, hide, or disable it. Unsubscribe requests must be honoured promptly and permanently. Do not email anyone who has unsubscribed, complained, or asked you to stop.
3. Prohibited content and behaviour
You may not use Nimbl Mail to send or promote:
- Spam, unsolicited bulk email, or chain letters.
- Content that is illegal, fraudulent, deceptive, or misleading, including false headers, subject lines, or sender details.
- Phishing, malware, viruses, or links to malicious or deceptive sites.
- Pornographic, hateful, harassing, or defamatory material.
- Pump and dump schemes, illegal gambling, pyramid schemes, or other prohibited financial promotions.
- Anything that infringes another person's intellectual property or privacy rights.
4. Keep your lists clean
High bounce and complaint rates damage deliverability for everyone. You must maintain healthy sending practices:
- Remove invalid and bouncing addresses. We suppress hard bounces automatically.
- Keep spam complaint rates low. Sustained complaints above accepted industry thresholds may lead to throttling or suspension.
- Warm up new sending gradually. We apply automatic warm up limits to protect your reputation.
5. Legal compliance
You are responsible for complying with all laws that apply to your sending, including the Protection of Personal Information Act (POPIA) in South Africa and, where relevant, laws such as the GDPR and the CAN-SPAM Act. This includes having a lawful basis to process personal information, honouring data subject rights, and providing accurate sender identification.
6. Enforcement
To protect our sending reputation and other clients, we may, with or without notice depending on severity: pause or throttle your sending, disable a campaign, suspend your account, or terminate it. We may also reduce sending limits for a destination when a mailbox provider signals a problem. We aim to be fair and to contact you first where it is safe to do so, but we will act immediately in cases of clear abuse.
7. Reporting abuse
If you believe someone is misusing Nimbl Mail, or you received email you did not consent to, contact us at abuse@nimbl.one and we will investigate.
8. Changes
We may update this policy from time to time. Material changes will be communicated, and continued use of Nimbl Mail after an update means you accept the revised policy.
